Just a quick question. Can a fire district/department dismiss a volunteer for failing to meet his call quota while serving on active duty in the military? Is there a law regarding this, or does it come down to the department's bylaws?
Every dept should have some sort of military leave policy. I cant see anybody getting dismissed for not making quota while away at war. If anyone ever did, that said department should be on the front cover of newsrag trying to explain themselves.
As far as I know LOSAP works at the state level, time spent on AD counts towards LOSAP.
Your department needs to grant you a LOA though, ours grants them on the company level for military leave.

It took me forever, but I finally found the NYS laws that cover this:
General Municipal Law, Article 10, Section 200-C.
It basically states that a volunteer firefighter on active duty can request a military leave of absence from his fire company. It also states that he may "perform services and duties as a volunteer firefighter during any period in which the armed forces of the United States grants the volunteer firefighter a temporary leave from military service."
When my national guard unit was called to active duty after 9/11 i just put in for military leave to be excused for the time i was away. we also had a member who joined the army after college on active duty and he was on military leave as well. i dont see any dept making a problem out of this.

Never heard about that happening. I have a guy in my department who is in the national guard and currently over in Iraq, my department had a going away party for him. If a department or district does that, that would be absolutely ridiculous.
I was just hesitant to apply for Military LOA because I feared that I would not be able to go on calls when I came home for holidays and leave. I figured this could help keep other military vollies at ease.
I was able to ride when I was home on leave. A few people made an issue of it at first, but in the end it worked out. I finally resigned after being on military leave for about 7 years realizing that I was going to make it a career and probably wouldn't be coming back to the island to retire.
